Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of Vext Chat ("we", "us", "our") services, including our website at vext.chat, our messaging automation platform, APIs, and all related services (collectively, the "Services"). This AUP is incorporated by reference into our Terms of Service.

VIOLATION OF THIS POLICY may result in immediate suspension or termination of your account, reporting to appropriate authorities, and legal action. We reserve the right to remove content, suspend services, and cooperate with law enforcement as necessary.

1. Prohibited Content and Activities

You may not use the Services to create, send, store, or distribute any content, or engage in any activity, that:

1.1 Illegal Activities

  • Violates any applicable local, state, national, or international law or regulation.
  • Promotes or facilitates illegal activities, including fraud, theft, or money laundering.
  • Involves the sale, distribution, or promotion of illegal goods or services.
  • Constitutes criminal activity of any kind.

1.2 Harmful or Dangerous Content

  • Promotes violence, terrorism, or extremist ideologies.
  • Contains threats, harassment, intimidation, or cyberbullying.
  • Promotes self-harm, suicide, or eating disorders.
  • Contains graphic violence or gore without legitimate educational or documentary context.
  • Promotes dangerous activities or challenges that could result in serious physical harm.

1.3 Discriminatory or Hateful Content

  • Promotes discrimination, hatred, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, national origin, age, or any other protected characteristic.
  • Uses slurs, hate speech, or dehumanizing language.
  • Promotes extremist ideologies or hate groups.

1.4 Sexual or Adult Content

  • Contains sexually explicit content, pornography, or obscene material.
  • Promotes sexual services, escort services, or adult entertainment.
  • Contains content that sexually exploits or endangers children (this will be reported to authorities immediately).

1.5 Spam and Unwanted Communications

  • Sends unsolicited messages, spam, or bulk communications without proper consent.
  • Uses harvested, purchased, or rented contact lists without documented consent.
  • Sends messages without required opt-in consent or in violation of applicable anti-spam laws (CAN-SPAM, TCPA, GDPR, etc.).
  • Engages in "robocalling" or automated predictive dialing techniques.
  • Uses misleading or deceptive subject lines, sender names, or message content.

2. Messaging Compliance Requirements

When using Vext for WhatsApp, Telegram, or other messaging services, you must:

2.1 Consent and Opt-In

  • Obtain proper opt-in consent before sending messages, as required by WhatsApp Business API Terms, Telegram Terms, and applicable law.
  • Maintain records of consent that can be produced upon request.
  • Honor opt-out, unsubscribe, and STOP requests immediately and permanently.
  • Not circumvent, bypass, or disable opt-out mechanisms.

2.2 Content Requirements

  • Include clear identification of your business in messages.
  • Provide clear opt-out instructions in every message where required by law.
  • Not send messages outside of permitted hours (generally 8 AM - 9 PM local time of the recipient).
  • Not use misleading or deceptive content in messages.

2.3 Prohibited Message Categories

The following message categories are prohibited (in addition to general prohibited content above):

  • Loan, payday loan, or high-interest lending solicitations.
  • Debt collection messages (unless you are the original creditor with proper consent).
  • Work-from-home, get-rich-quick, or pyramid scheme promotions.
  • Gambling, betting, or casino promotions (unless explicitly permitted by the messaging platform and local law).
  • Cryptocurrency or NFT investment schemes without proper disclosures.
  • Pharmaceuticals or medical products requiring prescriptions.
  • Tobacco, vaping, or nicotine products.
  • Firearms, weapons, or explosives.
  • Drugs, controlled substances, or drug paraphernalia.

3. Security and Technical Restrictions

You may not:

3.1 System Interference

  • Attempt to bypass, disable, or interfere with security features or access controls.
  • Probe, scan, or test the vulnerability of our systems or networks.
  • Breach or circumvent authentication measures or security protections.
  • Access non-public areas of our systems without authorization.

3.2 Malicious Activities

  • Introduce viruses, malware, ransomware, or other malicious code.
  • Launch denial-of-service attacks or distributed denial-of-service (DDoS) attacks.
  • Engage in activities that disrupt or interfere with the Services or other users' use of the Services.
  • Use excessive bandwidth or resources that could impair service performance for others.

3.3 API and Automation Abuse

  • Use our APIs in violation of our API documentation or rate limits.
  • Circumvent API rate limits through multiple accounts or other means.
  • Scrape, harvest, or collect data from our platform without authorization.
  • Use automated means to access the Services in a way that violates our Terms.
  • Reverse engineer, decompile, or disassemble any aspect of our software or services.

3.4 Impersonation and Misrepresentation

  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Forge headers or otherwise manipulate identifiers to disguise the origin of any content.
  • Create fake accounts or use false credentials.
  • Use caller ID spoofing or similar deceptive practices.

4. Data Protection and Privacy

When processing personal data through our Services, you must:

  • Comply with all applicable data protection laws, including GDPR, CCPA/CPRA, and other privacy regulations.
  • Have a lawful basis for processing personal data (consent, contract, legal obligation, etc.).
  • Provide appropriate privacy notices to data subjects.
  • Honor data subject rights requests (access, deletion, rectification, etc.) within required timeframes.
  • Implement appropriate security measures to protect personal data.
  • Not process sensitive personal data (health data, biometric data, etc.) without additional safeguards and legal basis.
  • Not transfer personal data to third parties without proper authorization and safeguards.

5. Intellectual Property

You may not:

  • Infringe any patent, trademark, trade secret, copyright, or other intellectual property rights.
  • Use our trademarks, logos, or branding without our prior written consent.
  • Sell, resell, or commercially exploit the Services without authorization.
  • Copy, modify, create derivative works from, or publicly display any content from our Services without authorization.

6. Enforcement and Reporting

6.1 Our Rights

We reserve the right to:

  • Monitor use of the Services for compliance with this AUP (without obligation to do so).
  • Remove or disable access to content that violates this AUP.
  • Suspend or terminate accounts that violate this AUP.
  • Report illegal activities to appropriate law enforcement authorities.
  • Cooperate with law enforcement and regulatory investigations.
  • Share information with messaging platforms (WhatsApp, Telegram, etc.) regarding policy violations.

6.2 Reporting Violations

If you become aware of any violation of this AUP, please report it to us immediately at info@vext.chat or for security-related issues at security@vext.chat.

6.3 Appeals

If you believe your account was suspended or terminated in error, you may appeal by contacting us at info@vext.chat. We will review your appeal and respond within a reasonable timeframe.

7. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in our practices, legal requirements, or operational needs. We will notify you of material changes by:

  • Posting the updated policy on this page with a revised "Last updated" date.
  • Sending an email to registered users for significant changes.
  • Displaying a notice in the application.

Your continued use of the Services after changes are posted constitutes your acceptance of the revised policy.
